Nagare Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the Nagare media player application (the “App”) and the website at nagare.live (together, the “Service”). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not install or use the Service.
1. What Nagare Is (and Is Not)
Nagare is a free, general-purpose video player application that also supports media streaming. It plays media from sources you configure on your own device, using video and audio formats supported by your operating system.
Nagare is not a content service. We do not provide, host, transmit, store, recommend, curate, resell, distribute, license, or have any commercial relationship with any streaming service, IPTV provider, channel, playlist, program guide (EPG), movie, series, sports event, or any other content. We do not pre-load, suggest, or facilitate access to any specific provider. To use the App you must independently obtain access to a streaming source from a third party of your choosing.
The App is free of charge. We do not charge for the App, do not sell subscriptions or in-app purchases, and do not run advertising. An optional donation channel may be linked from within the App; see Section 7.
2. Eligibility
You must be at least 13 years old (or 16 in jurisdictions where that is the applicable age of digital consent) to use the Service. By using the Service you represent that you meet this requirement and that you are using it in compliance with all laws that apply to you.
3. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use.
All rights not expressly granted are reserved. You may not:
- copy, modify, distribute, sell, lease, or sublicense any part of the App or the Service;
- reverse engineer, decompile, or attempt to derive the source code, except to the extent applicable law expressly permits despite this limitation;
- remove, obscure, or alter any proprietary notices on or in the Service;
- use the App or any data it produces to build a competing product or to train a machine-learning model;
- circumvent any technical limitation, rate limit, or security measure built into the Service.
4. Third-Party Streaming Services - You Choose, You Are Responsible
The choice of which streaming service or content source to connect to the App is entirely yours, and you are solely and exclusively responsible for that choice and for everything that follows from it. This includes, without limitation, responsibility for:
- the legality, in your jurisdiction, of the service you connect to and of the content it transmits;
- having all necessary rights, licenses, subscriptions, and permissions to access that content;
- the accuracy, decency, quality, availability, and safety of anything transmitted by that service;
- any fees, taxes, contractual obligations, or disputes arising from your relationship with that provider;
- any malware, fraud, or harm caused by content or links delivered by that provider.
Nagare has no relationship - commercial, legal, technical, or otherwise - with any IPTV provider, content service, or rightsholder. We do not see what you watch, do not see who you connect to, do not receive any payment, commission, or kickback from any provider, and have no ability to control, monitor, modify, filter, or block what is transmitted between you and the service you chose. The App acts only as a passive player at your direction. Your use of any third-party service is governed by that service’s own terms and privacy policy, not by these Terms. Disputes between you and a third-party provider must be resolved between you and that provider; Nagare is not a party to that relationship and has no role in resolving it.
Communication between the App and your chosen provider may, at the provider’s option, occur over unencrypted HTTP. We have no control over this and cannot guarantee the confidentiality of credentials or data sent to a provider that does not support HTTPS.
5. Acceptable Use
You agree that you will not use the Service to:
- access, store, or transmit content you do not have the legal right to access in your jurisdiction, including content that infringes copyright, trademark, or other intellectual-property rights of others;
- violate any applicable law, regulation, or court order;
- transmit malware, attempt to interfere with the Service, or probe, scan, or test the vulnerability of any system associated with the Service without authorization;
- harass, threaten, or harm any other person, or impersonate any person or entity;
- use automated means (scrapers, bots) to access the Service in a way that places undue load on it.
You acknowledge that whether a particular streaming source is lawful in your country is your responsibility to determine. The App itself is a general-purpose media player and does not facilitate any specific source.
6. Intellectual Property
The Service, including the Nagare name, the 流 logo, the wordmark, the App’s design, code, and the website, is owned by us or our licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms transfers any ownership of our intellectual property to you.
Third-party trademarks (such as Apple, App Store, Android, Google Play, Apple TV, iOS, iPadOS, macOS) are the property of their respective owners and are used here for descriptive purposes only.
7. Free of Charge; Optional Donations
The App is provided free of charge. There is no purchase price, no subscription, no in-app purchase, and no advertising.
The App may, at our option, link to a voluntary donation channel. Donations are voluntary, non-refundable, and do not entitle you to any additional product, feature, level of service, support obligation, or warranty. Donations are not payments for the App or for any content.
8. Codecs
Playback of media formats (such as H.264, HEVC/H.265, AAC) is provided by your operating system’s built-in media frameworks (for example, AVFoundation / VideoToolbox on Apple platforms). Nagare does not bundle, distribute, or sublicense any codec implementation of its own. Any codec licensing obligations are between you, the device manufacturer, and the applicable patent holders.
9. Updates and Changes to the App
We may release updates, modify, suspend, or discontinue the App (in whole or in part) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.
We do not warrant that the App will work with any particular third-party streaming service, that streams will be available, that playback will be uninterrupted, that any provider you connect to is lawful or trustworthy, or that the App will be compatible with every device or operating-system version.
11. Limitation of Liability
To the maximum extent permitted by law, in no event will Nagare or its contributors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of, or inability to use, the Service - even if we have been advised of the possibility of such damages.
Without limiting the foregoing, we have no liability whatsoever for any act, omission, content, transmission, security practice, billing practice, malware, or unlawful conduct of any IPTV provider, streaming service, or other third party that you choose to connect to the App.
To the extent any liability cannot be excluded by law, our total cumulative liability to you for all claims arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim (which, for a free App, is zero) and (b) ten US dollars (USD 10).
12. Indemnification
You agree to defend, indemnify, and hold harmless Nagare and its contributors from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) any content, credentials, provider, or third-party service you connect to the App, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party - including, without limitation, claims by content rightsholders concerning streams you accessed through a provider you chose.
13. Intellectual-Property Complaints / Takedown Notices
Nagare does not host, store, transmit, or have access to any user content or stream. We are a player application that runs entirely on the user’s device. Accordingly, there is nothing on our servers that we can “take down.”
Nevertheless, if you are a rightsholder and you believe that a user is using the App to access your content without authorization, you may contact us in good faith at privacy@nagare.live with the following information:
- your full name, postal address, and email;
- identification of the work you claim is being infringed;
- the URL or address of the alleged infringing source;
- a statement, made in good faith, that the use is not authorized by you, your agent, or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rightsholder or authorized to act on the rightsholder’s behalf;
- your physical or electronic signature.
We will review notices in good faith. Because we do not host the content and have no control over what providers transmit, our ability to act is limited, but we may, where appropriate, forward complaints to relevant parties or take other reasonable steps.
14. Termination
These Terms apply for as long as you use the Service. You may stop using the Service at any time by uninstalling the App. Uninstalling the App removes all locally stored data (credentials, favorites, viewing history) from your device; because we do not run a backend that stores user data, no further deletion request to us is necessary.
We may suspend or terminate your access to the Service, or any feature of it, at any time and for any reason, including for any violation of these Terms. Sections of these Terms that by their nature should survive termination (including Sections 4, 6, 10, 11, 12, 13, 16, and 17) will survive.
15. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including without limitation acts of God, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications outages, failures of upstream providers, and pandemic-related restrictions.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts of Tel Aviv-Yafo, Israel will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, except that we may seek injunctive or equitable relief in any jurisdiction where infringement of our intellectual property is occurring.
If you are a consumer in the European Economic Area or another jurisdiction whose mandatory consumer-protection laws grant you additional rights, nothing in these Terms limits those rights.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top and, where appropriate, post a notice in the App or on the website. Continued use of the Service after the updated Terms take effect constitutes acceptance of the changes. If you do not agree to the updated Terms, stop using the Service.
18. Apple App Store Additional Terms
If you obtained the App through the Apple App Store, the following also apply, in addition to the rest of these Terms:
- Acknowledgement. These Terms are concluded between you and us only, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content.
- Scope of License. The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Maintenance and Support. We are solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
- Warranty. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
- Product Claims. We, not Apple, are responsible for addressing any of your or any third party’s claims relating to the App or your possession and/or use of the App, including, but not limited to: (a) product-liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual-property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual-property infringement claim.
- Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-Party Beneficiary. You and we acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
19. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and Nagare regarding the Service. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
